Overview

Brian Maloof handles matters in New Jersey and Florida. He has successfully litigated cases involving construction defect claims related to single-family homes, condominium developments and commercial properties. Multiple parties are usually involved and these complex cases typically include allegations of code violations, negligence, warranty violations, breach of contract and consumer fraud.

Claims concerning insurance coverage and contractual indemnification are often a critical component of these construction defect matters. Mr. Maloof appreciates that these cases rely on the interpretation of indemnity agreements, flow-down provisions and other risk transfer mechanisms. As such, he is well aware of the changes in case law and statutory law that may potentially affect the outcome of a case.

Mr. Maloof is well known for his aggressive approach in pursing contractual defense and indemnity obligations as well as the enforcement of additional insured rights. He has successfully represented contractors in multi-million dollar construction defect cases which have been resolved through Mediation. To this end, Mr. Maloof has minimized his clients’ contributions by securing significant monies from other subcontractor defendants towards global settlement deals.

Mr. Maloof has litigation experience in other civil matters, including premise liability, dram shop litigation, truck, bus and automobile litigation, product liability, work related accidents and other matters. He has represented clients in court hearings and has obtained a number of civil remedies for clients in state and federal court.
